Welcome to Omen, a decentralized prediction market platform operated by Omen Labs ("we," "our," or "us"). By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you may not access or use our services. We reserve the right to update these Terms at any time, and your continued use of the platform constitutes acceptance of any modified Terms.

2. Eligibility and Account Registration

2.1 Age Requirement

You must be at least 18 years old to use Omen. By using our platform, you represent and warrant that you meet this age requirement.

2.2 Jurisdiction Restrictions

Our services may not be available in all jurisdictions. You are responsible for ensuring that your use of Omen complies with all applicable laws and regulations in your jurisdiction. You may not use our services if you are located in, or a citizen or resident of, any jurisdiction where such use would be illegal or prohibited.

2.3 Wallet Connection

To access certain features of our platform, you must connect a compatible cryptocurrency wallet. You are solely responsible for maintaining the security of your wallet and private keys. We do not have access to your private keys and cannot recover your wallet if you lose access to it.

3. Platform Description

Omen is a decentralized prediction market platform that allows users to:

• Create and participate in prediction markets
• Trade on future event outcomes
• Earn Omen Points (OMEN) through platform activities
• Build a verifiable prophet profile
• Participate in referral programs and rewards

4. User Responsibilities

4.1 Lawful Use

You agree to use Omen only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations
• Engage in fraudulent or manipulative trading practices
• Create markets or make predictions related to illegal activities
• Attempt to circumvent or manipulate our reward systems
• Use automated systems or bots without authorization
• Interfere with the proper functioning of the platform

4.2 Market Creation

When creating prediction markets, you agree to:

• Provide accurate and clear market descriptions
• Define objective resolution criteria
• Not create markets that violate these Terms
• Comply with all applicable laws regarding prediction markets

5. Trading and Transactions

5.1 Trading Risks

Trading on prediction markets involves significant risk. You may lose some or all of your deposited funds. You acknowledge and accept all risks associated with:

• Market volatility and price fluctuations
• Smart contract vulnerabilities
• Blockchain network issues
• Market manipulation or fraud by other users
• Changes in applicable laws or regulations

5.2 Transaction Finality

All transactions on Omen are executed through smart contracts on the blockchain and are generally irreversible. You are responsible for verifying all transaction details before confirmation.

5.3 Fees

Omen may charge fees for certain transactions or services. These fees will be clearly disclosed before you complete a transaction. You are also responsible for any blockchain network fees (gas fees) required to execute transactions.

6. Omen Points (OMEN) and Rewards

6.1 OMEN System

Omen Points (OMEN) are earned through platform activities such as trading, market making, holding positions, and referrals. OMEN may be used to determine eligibility for future airdrops and rewards.

6.2 No Guaranteed Value

OMEN have no inherent monetary value and do not represent any ownership, equity, or claim in Omen Labs. We make no guarantees regarding the future utility, value, or transferability of OMEN.

6.3 Modifications

We reserve the right to modify, suspend, or discontinue the OMEN system or any reward programs at any time without notice. We may also adjust OMEN balances if we detect fraudulent or abusive behavior.

7. Intellectual Property

7.1 Platform Ownership

All content, features, and functionality on Omen, including but not limited to text, graphics, logos, icons, images, and software, are owned by Omen Labs or its licensors and are protected by copyright, trademark, and other intellectual property laws.

7.2 User Content

By creating markets or posting content on our platform, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with operating the platform.

8. Disclaimers and Limitations of Liability

8.1 No Warranties

OMEN IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The platform will be uninterrupted or error-free
• Any defects will be corrected
• The platform is free from viruses or harmful components
• The results obtained from using the platform will be accurate or reliable

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMEN LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Loss of cryptocurrency or digital assets
• Business interruption
• Any other commercial damages or losses arising from your use of Omen

8.3 Not Financial Advice

Nothing on Omen constitutes financial, investment, legal, or tax advice. You should consult with appropriate professionals before making any financial decisions.

9. Indemnification

You agree to indemnify, defend, and hold harmless Omen Labs, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of Omen, your violation of these Terms, or your violation of any rights of another.

10. Market Resolution

Markets on Omen are resolved based on real-world outcomes and predefined resolution criteria. We strive to ensure fair and accurate market resolution, but we do not guarantee the accuracy of any particular resolution.

In cases of disputes or ambiguity, we may utilize community governance mechanisms or third-party arbitration services to determine market outcomes.

11. Suspension and Termination

We reserve the right to suspend or terminate your access to Omen at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or abusive behavior
• Legal or regulatory requirements
• Security concerns

Upon termination, your right to access and use Omen will immediately cease. However, you may still be able to withdraw your funds subject to applicable laws and smart contract functionality.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Omen Labs is established, without regard to its conflict of law provisions.

12.2 Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of Omen shall be settled by binding arbitration in accordance with the applicable arbitration rules, except where prohibited by law. The arbitration shall be conducted in English.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Omen Labs regarding your use of the platform.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
